Background

Baise Tianyang power station is a two-unit coal-fired power plant with a total capacity of 300 MW. The 2*150MW units were completed in 2007, and is owned by Guangxi Baise Mining Group.[1]

The power plant retreated from Guangxi Public Grid without any permit, joining Baise local grid instead, which is owned and run by Baise Power Power Co.[2][3] This action led to the cancellation of its electricity business license and a ¥900,000($132,000) fine in August 2016 imposed by NEA Southern Energy Supervision Bureau. [4]

The power company is continuing operating even without the license.

2017年6月8日,南方能监局向广西百色银海发电有限公司下发行政处罚决定书(南方监能字【2017】22号): 经调查核实,你公司所属田阳电厂在未向有关部门办理相关退网手续,未经电力调度机构同意的情况下,违规操作调度机构调度管辖范围内的设备,自行断开与广西电网的联接,违规并入百色区域电网运行;且你公司在我局下发监管整改通知书后仍拒不按要求落实整改,情节严重。依据《电力监管条例》第三十一条和《电力市场监管办法》第三十四条规定,我局决定对你公司作出罚款900,000.00元人民币(大写:玖拾万元人民币)和吊销电力业务许可证的行政处罚。 2017年5月9日,我局向你公司送达了《行政处罚事先告知书》(南方监能稽查〔2017〕115号)。2017年5月18日,你公司向我局提出了陈述和申辩。经我局行政处罚委员会审议认为,你公司所作的陈述和申辩无新的事实与证据,对我局行政处罚决定提出的申辩理由不属于法定免予处罚的情形且不成立,不足以改变对你公司的行政处罚。
