Background on Mine

The Karwahi Open Cast Coal Mine Project of 1.2 MTPA on a mining lease area of 335.736 ha is located in villages Karwahi, Dist. Raigarh, Chhattisgarh, India. The project received its Environment Clearance on 30th September 2005. [1] The mine was operated by M/s Raipur Alloys and Steel Ltd. Later on the Environment Clearance for Karwahi OC Mine was transferred from M/s Raipur Alloys & Steel Ltd. to M/s Monnet Ispat & Energy Limited by the MoEF&CC Order dated 11th May 2015. [2]

In 2018, The Mumbai Bench of the National Company Law Tribunal (NCLT) has dismissed a petition by Monnet Ispat’s resolution professional against the ministry of coal for issuing a termination notice of its coal mine in Chattisgarh.The tribunal said that the action of the ministry is not hit by section 14 (1) (d) of the Insolvency and Bankruptcy Code (IBC), which deals with moratorium on recoveries. Section 14 (1) (d) of the IBC says that the “adjudicating authority shall by an order declare moratorium for prohibiting the recovery of any property by an owner or lessor where such property is occupied by or in the possession of the corporate debtor”. “In the code itself, it has been categorically mentioned that if notification comes from the government side in respect to any of the issues, then the provisions of 14 (1) will not apply to the transactions notified by the central government. In view of the reasons aforementioned, this miscellaneous is hereby dismissed as misconceived,” the order said. [3]

M/s South Eastern Coalfields Limited (SECL) has taken over the possesion of Karwahi OC Mine on 27.12.2019. To operate the Karwahi OC Mine project, SECL has applied for the transfer of the EC from M/s Monnet Ispat & Energy Limited to M/s South Eastern Coalfields Limited to MoEF&CC on 17th January 2020. [4]
