Background
The Elan Coal Mine is a proposed mine located in the Crowsnest Pass area of southern Alberta, Canada, and owned by Atrum Coal.
Project Shelving
In 2022, the Government of Alberta issued a moratorium on new coal exploration and development in the eastern slopes of Canada's Rocky Mountains, essentially shelving the Elan coal project.
In response, Atrum Coal commenced a claim against the Government of Alberta in 2023 for "de facto expropriating" Elan's coal leases and is seeking monetary compensation pursuant to the doctrines of private nuisance and unjust enrichment.[4] A trial date of April 2025 has been set.[5]
Alberta's government actually lifted its coal mining moratorium in January 2025.[6] It is unclear whether or not Atrum intends to restart planning for the Elan project.
